CONDIZIONI GENERALI DI CONTRATTO
OGGETTO: Le presenti condizioni generali hanno per oggetto le norme per l'abbonamento gratuito al servizio fornito da EPYX s.p.a., che è regolato, oltre che dalle Condizioni Generali, dalla Richiesta di adesione al Servizio. GamesNet.it è un servizio gratuito che consiste nell’accesso a tempo indeterminato al server messo a disposizione.
DURATA DEL CONTRATTO: L'abbonamento al servizio ha durata indeterminata salvo revoca da comunicare, per entrambe le parti, via email con un preavviso minimo di 30 giorni.
ATTIVAZIONE E SOSPENSIONE: Il contratto si perfeziona nel momento in cui GamesNet.it fornisce il servizio sulla base dell'accettazione on line delle condizioni di contratto da parte dell'utente. In caso di mutamento delle condizioni tecniche e normative per la fornitura del servizio, EPYX s.p.a. avrà il diritto potestativo di sospendere in qualsiasi momento la fornitura del servizio con un preavviso di quindici giorni notificato via posta elettronica all'indirizzo collegato al presente contratto di abbonamento.
RISERVATEZZA: L'accesso a GamesNet.it è consentito mediante un codice di identificazione cliente (UserID) e una parola chiave (Password). Il cliente è tenuto a conservare la password con la massima diligenza, mantenendo segreti per tutta la durata dell'abbonamento sia il codice che la parola chiave. Il cliente sarà pertanto esclusivamente responsabile di qualsiasi danno causato dalla conoscenza, ovvero dall'utilizzo, della password o della UserId da parte di terzi. Il cliente si impegna a comunicare immediatamente a EPYX s.p.a. l'eventuale furto, smarrimento, perdita ovvero appropriazione a qualsivoglia titolo da parte di terzi della password o UserId.
GARANZIE: Il cliente garantisce che qualunque materiale o messaggio eventualmente immesso in aree pubbliche di GamesNet.it riconducibile allo stesso in virtù del codice di identificazione e/o password è di propria titolarità e/o nella propria disponibilità giuridica, in difetto obbligandosi il cliente a manlevare e tenere indenne la EPYX s.p.a. da ogni eventuale conseguenza pregiudizievole. Il cliente inoltre garantisce che detto materiale non viola o trasgredisce alcun diritto di autore, marchio di fabbrica, brevetto o altro diritto derivante dalla legge, dal contratto e dalla consuetudine. Il cliente prende inoltre atto del fatto che è vietato servirsi o dar modo ad altri di servirsi di GamesNet.it per utilizzi contro la morale e l'ordine pubblico o con lo scopo di recare molestia alla quiete pubblica o privata, di recare offesa, o danno diretto o indiretto a chicchessia e di tentare di violare comunque il segreto dei messaggi privati.
UTILIZZO DELL'ABBONAMENTO: Il cliente potrà utilizzare l'abbonamento per un singolo accesso. In particolare è espressamente esclusa la possibilità di cedere il contratto di abbonamento a terzi, a titolo gratuito o oneroso, temporaneamente o definitivamente, senza il consenso scritto di EPYX s.p.a..
CLUB GamesNet.it: L'abbonato prende atto che l'adesione al servizio GamesNet.it rende automatica l'iscrizione al Club GamesNet.it. Il Club si pone l'obiettivo di procurare vantaggi esclusivi ai propri associati per l'acquisto di prodotti e di servizi on line di volta in volta proposti dal club mediante il servizio di posta elettronica. EPYX s.p.a. si impegna a non inviare più di un messaggio di posta elettronica al giorno legato all'iniziativa Club GamesNet.it.
CLAUSOLA RISOLUTIVA ESPRESSA: In tutti i casi di inadempimento delle obbligazioni di cui agli artt. 4,5,6 al presente contratto, EPYX s.p.a. avrà la facoltà di risolvere il presente contratto ai sensi dell'art.1456 c.c., fatta salva, in ogni caso, azione di rivalsa e risarcimento per i danni subiti. Il diniego e/o la revoca dall'abbonato al trattamento dei propri dati darà facoltà a EPYX s.p.a. di considerare risolto di diritto il presente contratto.
COMUNICAZIONI: Tutte le comunicazioni relative al contratto andranno inviate agli indirizzi di posta elettronica del cliente.

Epyx S.p.A. is committed to protecting your privacy. his privacy statement explains data collection and use practices of the GamesNet (www.gamesnet.it) site and other online or offline Epyx S.p.A. sites, products or services.
GamesNet is a service that allows users to create a single user name and password, referred to as GUL (GamesNet Universal Login which can be used to sign-in to any sites or services on the Epyx S.p.A. Network. By using the GamesNet website, you consent to the data practices described in this statement.
Collection of your Personal Information
As described in greater detail below, we collect and process personal information to operate an authentication service and to improve security and provide customer support for the GamesNet network.
What Information Is Collected
GamesNet collects only that information which is necessary to carry out the two purposes described above. When you use credentials running on GamesNet to sign-in to a site or a gaming online service, GamesNet temporarily logs the place where you are signing in as a part of your sign-in activity, as described below.
The Registering Site's Determination of What Information Is Collected
You can register for credentials at a site or service on the GamesNet website: www.gamesnet.it.
All of the information you provide during sign up at such a site may be stored by that site. As described above, GamesNet stores only the username and password.
Epyx S.p.A.'s use of your personal information
We inform you that all these data will keep you informed on our news and promotions. Epyx S.p.A. will not sell or rent your personal information to third parties, will not use or share your personal information in a manner that differs from what is described in this Privacy Statement without your prior consent.
How GamesNet uses your personal information
GamesNet uses your personal information for the operation and maintenance of the GUL service. For example, if you have provided an e-mail address, GamesNet uses your e-mail address to send you a welcome e-mail message to which you must respond in order to confirm that you are the owner of the e-mail address associated with those credentials. This process is designed to verify the validity of the e-mail address and to help prevent e-mail addresses from being used without permission by the owners in the creation of the GUL account.
GamesNet may also send you e-mail about periodic service or recommended updates. These periodic e-mails are considered essential to the provision of the service, and you cannot unsubscribe from these mailings.
If you need to reset your password and cannot access your primary e-mail account, GamesNet may send password reset e-mail to your alternate e-mail address, after having checked registration data correspondance.
GamesNet's s general disclosure of personal information
GamesNet occasionally hires other companies to provide limited services on our behalf, such as answering customer support inquiries or performing statistical analyses of our services. GamesNet will only provide these companies with those pieces of your personal information needed to deliver the services, and the companies and their employees are prohibited from using that personal information for any other purpose. GamesNet may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to legal requirements or comply with legal process served on Epyx S.p.A.; (b) protect and defend the rights or property of Epyx S.p.A., GamesNet or sites or services on the GamesNet network; or (c) act under urgent circumstances to protect the personal safety of users of GamesNet or the public.
Use of Shared Information by Sites and Services on GamesNet
Sites and services on GamesNet can use or share your username as described in their privacy statements. However they can only share your unique ID number with third parties in order to fulfill a service or transaction you may have requested.
All sites or services on GamesNet must contractually agree to have a posted privacy statement. You should carefully review the privacy statement for each site on GamesNet you sign up with or sign in to in order to determine how each site or service will use the information it collects.
Managing your personal information
Access to Your Personal Information
You can access your personal information by going to GamesNet's homepage. You can ch'ange your nickname, password, email address, home address and statistical data whenever you want. You can't change your name, surname, place and date of birth.
Closing Your GUL Account
You may close your GUL account by visiting GamesNet's main site.
Deactivation and account purging
Epyx S.p.A. will not delete your GUL account if it remains inactive for an extended period of time. Inactivity is defined as a failure to sign in to any site or service on GamesNet using your credentials.
Should it happen that tecnical conditions and laws regarding this service will change, Epyx S.p.A. may stop at will this service, provided it sends you an email announcement, 15 days earlier.
Should you violate our contract, by putting in false or imaginary data, or by subscribing more than one account per user, Epyx S.p.A. may stop this service, without any prior announcement.
Security and storage of your personal information
Epyx S.p.A. is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access, which are located in controlled facilities. When your username is sent to a site on GamesNet at sign-in, Epyx S.p.A. uses industry-standard security technologies to encrypt it for transmission over the Internet.
You must type the correct password to access your GUL account. It is your responsibility to ensure the security of your GUL credentials password and not to reveal this information to others.
Personal information collected by Epyx S.p.A. may be stored and processed in Italy or any other country in which Epyx S.p.A. or its affiliates, subsidiaries, or agents maintain facilities; by using GamesNet site, you consent to any such transfer of information outside of your country.
Use of Cookies
A cookie is a very small text file that a Web site saves to your computer's hard disk to store information that you provide about yourself or to store your preferences.
GamesNet uses cookies whenever you sign with your GUL. GamesNet stores your unique ID number, and the time you signed in, in an encrypted cookie on your hard disk. This cookie allows you to move from page to page at the site without having to sign in again on each page. When you sign out of GamesNet, these cookies are deleted from your computer.
GamesNet also uses cookies to improve the sign in experience. For example, GamesNet may store your username in a cookie that will remain on your computer after you sign out. This cookie allows your username address to be pre-populated, so that you will only need to type your password the next time you sign in. If you are using a public computer or do not otherwise want this information to be stored, you can select the appropriate button on the sign-in page, and this cookie will not be used.
The sites or services you visited may store their own cookies on your computer. Changes to this Privacy Statement
Epyx S.p.A. will occasionally update this Privacy Statement. When we do, we will also revise the "last updated" date at the bottom of the Privacy Statement. Epyx S.p.A. will obtain your opt-in consent for any updates to this Privacy Statement that materially expand the sharing or use of your personal information in ways not disclosed in this Privacy Statement at the time of collection.

REGOLAMENTO FORUM
Gli utenti devono impegnarsi a rispettare quanto sotto riportato:
1. E' VIETATO l'uso di terminologie scurrili o acronimi richiamanti religioni o qualunque forma di fede. Verranno inoltre PUNITI atteggiamenti non rispettosi di idee, opinioni, religioni ed espressioni sarcastiche e denigratorie che andrebbero a ledere in qualunque modo la sensibilit? dei frequentatori del forum e la destabilizzazione della normale e serena partecipazione attiva. Ogni tentativo di FLAME, TROLLING, anche velato, verrà PUNITO.
2. E' VIETATO fare pubblicità (positiva o negativa) ad altri Portali di NetGaming e/o servizi equivalenti a quelli offerti da GamesNet.
3. E' VIETATO scrivere messaggi senza contenuto (SPAM - solo puntini, emoticons etc..) o fuori argomento, con l'intento, volontario o involontario, di creare flame ed appesantire le discussioni. E' rigorosamente VIETATO nominare, pubblicizzare o fare allusione a copie illegali, pirata, di materiale multimediale e non.
4. E' VIETATO inserire in firma e/o avatar frasi o immagini collegate a politica o religione ed utilizzare immagini volgari, frasi o parole che possano ledere gli utenti. Qualsiasi utilizzo di firme e/o avatar che richiamano altri utenti, anche in modo velato e senza il consenso degli interessati, verrà PUNITO. E' altresì VIETATO inserire in FIRMA immagini con particolari animazioni o bagliori intermittenti potenzialmente pericolosi per persone con disturbi di epilessia. E' inoltre VIETATO inserire link in firma, se non a servizi offerti da GamesNet (forum, hosting web etc...) o servizi di voto relativi agli shard GamesNet; sono invece consentiti i link all'interno dei post sui forum nei limiti stabiliti da questo regolamento, dal contratto GamesNet e dalle normative vigenti della legge italiana.
E' possibile l'inserimento di USER TITLE personalizzati. Non sono ammessi titoli offensivi o che in qualunque modo possano ledere la sensibilità della community. Non sono altresì ammessi usertitle riportanti tag Staff o comunque similari a qualche status preesistente (Administrator, GN Moderator, UOI Staff, UOD Staff etc...). Per l'utilizzo non autorizzato di user title di staff, la pena è il ban immediato.
5. E' CONSENTITO utilizzare UNA SOLA (1) immagine in firma e la sua grandezza MASSIMA non può superare i 60000 Pixel (300x200, 200x300, 150x400 - VIETATO 10x6000, 5000x12 etc..). E' CONSENTITO usare una o più frasi, ma il totale MASSIMO NON deve superarare le 6 RIGHE (a carattere Standard e NON intervallate da righe vuote).
6. E' VIETATO pubblicare discussioni o parti delle medesime avvenute in forma privata attraverso l'utilizzo di programmi di messaggistica istantanea (MSN, ICQ etc...), E-Mail etc senza il consenso della/e persona/e interessata/e e registrazioni audio/video senza il consenso della/e stessa/e.
7. Il FORUM è suddiviso in sezioni a tema per una migliore visione d'insieme. Gli utenti sono tenuti a prestare PARTICOLARE ATTENZIONE all'area più consona in cui vorranno aprire una nuova discussione, che verrà chiusa (o spostata) in caso di inottemperanza al regolamento.
8. E' CONSIGLIABILE scrivere in minuscolo, scrivere MAIUSCOLO viene definito "URLARE".
9. E' CONSIGLIABILE, quando si effettua un QUOTE (Citazione), eliminare la parte non strettamente inerente alla risposta.
10. Prima di postare riguardo ad un argomento è consigliabile LEGGERE le FAQ (Frequently Asked Questions).
11. L'operato dei Moderatori è INSINDACABILE ed è pertanto soggetto SOLO ed ESCLUSIVAMENTE all'Amministrazione del forum. Ogni attacco ingiustificato, denigratorio, maleducato nei confronti dello Staff Moderazione, sarà PUNITO.
